Executive Order: Construction Guidance Released on Washington State's "Stay Home, Stay Safe" Order

NAIOP, along with AGC, requested clarification on Governor Inslee's recent “Stay Home, Stay Safe” executive order as it relates to construction activities. The newly released Construction Guidance Memo is online.

The exception to the order allows for construction in the following limited circumstances:

a) Construction related to essential activities as described in the order;
b) To further a public purpose related to a public entity or governmental function or facility, including but not limited to publicly financed low-income housing; or
c) To prevent spoliation and avoid damage or unsafe conditions, and address emergency repairs at both non-essential businesses and residential structures.

There will be an opportunity to revisit the scope of the Order in 7-8 days based upon the metrics the state is using to determine if progress in addressing the outbreak is being made.  The metric includes a review of infection rates, hospitalization rates, and traffic indicators.

Washington State L&I does not currently require employers to have a written coronavirus disease prevention plan. However, they do require all employers to make their employees aware of the hazards associated with coronavirus and to provide prevention training as needed.
